Terms
The terms covering this website. The terms covering actual work are set out in the proposal for that engagement.
The short version
- Information, not advice
- Prices are indicative
- Engagements have their own terms
- Your data is yours
This website
Everything here is provided for information. We keep it accurate, but nothing on this site is a quote, an offer, or professional advice for your specific situation, that is what the diagnosis is for.
Pricing shown is indicative. Real numbers come from the diagnosis, in writing, before any build starts.
Case studies and figures
Case studies describe outcomes for specific clients, in their circumstances, with their constraints. They are evidence of what we have done, not a prediction of what you will get. Clients are anonymised by sector at their request, and the screenshots are produced from a demonstration environment with representative rather than real data.
Engagements
Diagnosis, build and ongoing care are governed by the proposal and scope document for that engagement, which takes precedence over anything on this site if the two ever disagree. Builds are quoted as a fixed price off the diagnosis; ongoing care is a monthly fee that either side can end with reasonable notice.
Intellectual property
The OctalHQ name, logo and the content of this site are ours, and so is the software behind the systems we build. Your data is yours from the first day, and all of it can leave with you at any time, as set out under Security, data & exit. How you can use the system itself is set out in the agreement for that engagement.
Your responsibilities
A diagnosis is only as good as the access behind it, so the accuracy of what we find depends on the accuracy of what we are shown. You are responsible for having the right to give us access to the systems and data you give us access to.
Liability
Nothing here excludes rights you have under the Australian Consumer Law, which cannot be contracted away. Beyond those, liability is limited as set out in the engagement agreement.
Governing law
These terms are governed by the law of the Australian state in which OctalHQ is registered, and the courts of that state have jurisdiction.
